La scelta è arrivata in seguito a un episodio che ha visto coinvolto il capitano della squadra asiatica, Son Heung–min, il 33enne attaccante ex Tottenham ora al Los Angeles Fc. Secondo quanto riportato da alcuni media internazionali, durante una seduta di allenamento a Guadalajara, in Messico, alcuni cronisti avrebbero deriso l’attaccante per il suo servizio militare e la conversazione sarebbe stata registrata e ascoltata in seguito dal gruppo. Nuovi ogm, la deregulation è legge. Coldiretti: “Aiuto per clima e fitopatie”. Ma il nodo sono i brevetti
Il Parlamento europeo dà la sua approvazione definitiva al futuro quadro normativo sulle nuove tecniche genomiche, in Italia chiamate anche tecniche di evoluzione assistita (Tea). La deregolamentazione di gran parte dei nuovi Ogm è legge e si tratta di uno dei cambiamenti più importanti degli ultimi decenni sulle norme comunitarie in materia di alimenti e mangimi geneticamente modificati. Da una parte si cerca di rispondere alla sfida dei cambiamenti climatici e della lotta alle fitopatie, dall’altra però da più parti si sottolinea il rischio concreto di concentrare in poche mani di alcuni grandi produttori il controllo del mercato delle nuove sementi geneticamente trattate. L’Aula di Strasburgo, di fatto, ha confermato l’intesa politica raggiunta a dicembre scorso con i Paesi Ue, bocciando tutti gli emendamenti presentati dai gruppi Socialisti e Democratici, Verdi e Sinistra per riaprire il testo. Si introduce, così, una distinzione tra piante derivate da Ngt di categoria 1 e Ngt di categoria 2. Le prime sono considerate “equivalenti alle piante convenzionali” per una questione di lunghezza delle sequenze di Dna modificate (meno di 20 nucleotidi). In base a questo parametro, le piante da Ngt di categoria 1 vengono esentate dalle attuali norme sugli Ogm: rimane l’obbligo di etichettatura per i sementi e altro materiale riproduttivo, ma non sarà richiesta alcuna valutazione del rischio ambientale o sanitario, né ci saranno obblighi di tracciabilità lungo la filiera o di etichettatura per il consumatore finale. Oltre il 94% dei nuovi Ogm esentato dalle attuali norme Le piante derivate da Ngt di categoria 2, con modifiche genomiche più complesse, rimangono soggette alla vigente legislazione europea in materia di ogm, comprese l’autorizzazione, la tracciabilità e l’etichettatura obbligatoria. Solo che circa il 94% dei nuovi Ogm allo studio rientra proprio nelle Ngt di categoria 1, quelle che verrebbero deregolamentate. Per Coldiretti “il via libera dell’Europarlamento al nuovo regolamento Ngt rappresenta una svolta epocale per il futuro dell’agricoltura italiana ed europea”, ma il Centro Internazionale Crocevia parla di un “passo indietro di venticinque anni che cancella valutazione dei rischi, tracciabilità ed etichettatura degli organismi geneticamente modificati realizzati con le nuove tecniche genomiche”. “Dopo le lobby delle armi, delle banche, delle assicurazioni e dei colossi petroliferi ed energetici oggi i partiti di destra scelgono di fare copia e incolla anche delle richieste dell’agribusiness” tuona l’eurodeputata del Movimento 5 Stelle, Valentina Palmisano. Il regolamento sui nuovi Ogm La riforma entrerà in vigore 20 giorni dopo la pubblicazione in Gazzetta ufficiale e si applicherà dopo due anni. Le norme si applicheranno sia alle piante originarie dell’Europa sia a quelle importate. Nei mercati al di fuori dell’Ue sono già disponibili diversi prodotti ottenuti da piante Ngt, per esempio il frumento a basso contenuto di glutine, le patate resistenti agli agenti patogeni e il mais tollerante alla siccità. La piena tracciabilità e l’etichettatura rimarranno obbligatorie solo per le piante di categoria Ngt 2 e i paesi dell’Ue potranno limitarne o vietarne la coltivazione anche se sono state autorizzate all’interno dell’Unione. Le varietà vegetali derivate da o contenenti una pianta Ngt 1 saranno invece inserite in una banca dati pubblica dell’Ue e tutti i sacchetti di sementi e il materiale riproduttivo dovranno essere etichettati come ‘Ngt 1’, in modo da informare gli agricoltori. In questo caso, i paesi membri dell’Ue non potranno avvalersi dell’opt out, cioè della facoltà di vietare la coltivazione sul proprio territorio, oggi applicata in larga maggioranza nell’Unione. Il regolamento rende obbligatorio il monitoraggio degli impatti sulla sostenibilità delle piante Ngt. Le nuove tecniche genomiche non saranno consentite nella produzione biologica. La Commissione europea è vincolata a valutare se il regolamento comporti oneri amministrativi, economici o pratici per gli operatori del settore biologico, anche in relazione alla loro percezione e a quella dei consumatori. La sfida dei cambiamenti climatici e delle fitopatie Coldiretti e Filiera Italia sottolineano che le nuove tecniche genomiche non hanno nulla a che fare con i vecchi Ogm transgenici e, anzi, “permettono di riprodurre in modo mirato i meccanismi della selezione naturale per rispondere alle crescenti sfide ambientali e produttive”. “Non si tratta di nuove specie – aggiungono – ma di un’evoluzione delle varietà esistenti, in grado di sviluppare una maggiore resistenza allo stress idrico e alle principali fitopatie, come l’oidio, con benefici anche sul fronte della riduzione degli agrofarmaci”. Secondo il presidente nazionale di Cia, Cristiano Fini “le nuove tecniche genomiche rappresentano uno strumento fondamentale per rafforzare la capacità delle imprese agricole di affrontare le sfide dei cambiamenti climatici e delle fitopatie, che già oggi determinano variazioni delle rese comprese tra il 20% e il 49%. Grazie all’innovazione varietale – ha commentato – sarà possibile sviluppare piante resistenti, meno idroesigenti e più capaci di adattarsi, coniugando produttività e sostenibilità”. Ma per una possibile soluzione che si trova, altri problemi rischiano di crearsi. Gli emendamenti bocciati Come quello dei brevetti. Sarà possibile brevettare le Ntg, ad eccezione dei tratti o delle sequenze presenti in natura o prodotti con mezzi biologici. E sono previste salvaguardie per impedire la concentrazione del mercato e garantire l’accessibilità economica e l’accesso equo per gli agricoltori, in modo che mantengano il diritto di conservare e ripiantare i semi. Non essendo passato, però, nessun emendamento che riguardava i brevetti, qualche perplessità resta. Non è passato, infatti, quello che limitava l’ambito di applicazione della protezione brevettuale per evitare l’estensione ai vegetali selezionati convenzionalmente, né quello sull’inversione dell’onere della prova nelle cause legali per violazione dei brevetti, entrambi presentati dal socialdemocratico Cristoph Clergeau, vicepresidente S&D e relatore ombra sulle Ngt. Le modifiche proposte miravano a garantire, come annunciato dallo stesso europarlamentare, un quadro normativo equo che non ceda il controllo delle sementi a una manciata di multinazionali. “Pur sostenendo l’innovazione nel settore della selezione vegetale e il suo potenziale per aiutare l’agricoltura ad adattarsi ai cambiamenti climatici – ha spiegato Clergeau – il gruppo S&D avverte che garanzie deboli sui brevetti rischiano di rafforzare il potere di mercato di pochi attori dominanti e di far aumentare i prezzi dei prodotti alimentari. È fondamentale che la legge non trasformi gli agricoltori in indagati. Se un’azienda sostiene che un agricoltore sta utilizzando un tratto genetico brevettato, spetta a tale azienda provarlo, non all’agricoltore dimostrare la propria innocenza”. Linea confermata, dopo il voto, dall’eurodeputato del Pd, Dario Nardella. “Le Ngt rappresenteranno un aiuto concreto per gli agricoltori, diverranno uno strumento fondamentale per accelerare lo sviluppo di varietà più resistenti agli stress climatici e alle fitopatie” spiega, sottolineando quello che ritiene essere “l’unico punto sul quale l’accordo non è ottimale”, ossia “la disciplina dei brevetti, che rischia di concentrare in poche mani di alcuni grandi il controllo del mercato delle nuove sementi geneticamente trattate, a scapito dei piccoli agricoltori”. Il nodo dei brevetti Questo, di fatto, è un punto critico.“Le Ngt sono tutte coperte da brevetti, di proprietà di poche grandi multinazionali del settore sementiero come Corteva, Bayer-Monsanto, Syngenta e Basf. Senza obbligo di rendere pubblici i metodi di rilevamento – denuncia Francesco Panié, campaigner del Centro Internazionale Crocevia – gli agricoltori e le piccole e medie imprese sementiere rimarranno indifesi in caso di contaminazione dovuta alla coltivazione nelle vicinanze di campi Ogm/Ngt. Questi brevetti coprono geni simili a quelli già presenti nei semi non Ogm e consentiranno quindi alle multinazionali di privatizzare anche le sementi tradizionali”. Lo dispone la Direttiva del ’98 che gli emendamenti non approvati dai parlamentari avrebbero modificato. “Ora le imprese potranno perseguire abusivamente gli agricoltori e i piccoli produttori di sementi per violazione di brevetto, nel caso le loro varietà contengano tratti genetici brevettati” aggiunge Paniè. Non solo: “L’onere della prova, infatti, ricadrà su chi subisce le contaminazioni tramite cui questi tratti genetici si trasferiscono, oppure chi semplicemente ha sviluppato gli stessi tratti tramite l’incrocio e la selezione naturale. Per le piccole imprese sementiere significherà dover fare costosissime, lunghe e impraticabili ricerche nei database dei brevetti per capire se stanno utilizzando sementi che contengono un tratto genetico privatizzato da qualche impresa”. Per Valentina Palmisano, europarlamentare del Movimento 5 Stelle la deregolamentazione delle Ngt “aumenta la dipendenza degli agricoltori da sementi brevettate, riducendo l’autonomia delle aziende agricole e mettendo a rischio la biodiversità che caratterizza il modello agricolo europeo. Ancora più grave – commenta – è la decisione di eliminare l’obbligo di etichettatura: i consumatori non potranno più distinguere tra un prodotto biologico o naturale e uno ottenuto tramite modificazione genomica.
